On Every time Bailable Warrant is issued Against the Default Party

I received a cheque of Rs.42000/- which was bounced and the party was not bothering to pay or even visit court. nBut on each date I received a same order "Today the case was fixed for presence of accused XXX by way of bailable warrant. Bailable warrant issued against accused Anil received back unexecuted. Let, fresh bailable warrants against accused Anil be again issued for XXXX.This was the 5th same order but the other person is enjoying his life and not even hire a advocate nor appeared in court till date.I want to know how to solve that thing also till when court will order the same thing.

Sir,
If you still have Bailable warrants issues, its time to het them converted to Non Bailable now. Probably your advocate can push for the same

as per your query
you filled complaint case under negotiable instrument act u/s 138 , primarily summoning done under normally form and after the bailable warrants no further action is taken by police, in this condition you have to contact police official who is going for summoning and request him to excute the orders.

You just need to change advocate or you say to the advocate to issue drastic notice as by issuing dasti notice the balifff (place official appointed by court) will take the notice with him and you have to go to the address of the accused by this bailiff will give the dasti notice report in the court for the non apperance of the accused or if the accused found on the address of the notice then you and the bailiff have to give notice in the hands of the accused

after the bailable warrant are issued the court should proceed for issuing of the non bailable warrant and even if accused does not appear after issuance of non bailable warrant he will be declared as a proclaimed offender and an FIR section 174 a of the IPC registered against him this depends upon how actively you and your lawyer are pursuing the case
