Not able to repay cheque amount in court what are the consequences?

I am an entrepreneur, a start up company. I have issued a cheque to get some work done related to my business. I am failed to make payment due to financial constraint. Now this person has file a case against me under penal code 138. I am going through a very tough time and not able to make payment in spite of commitment in front of Judge. Now I am not in the position to make the payment. What would be the consequences.

You have to pay the cheque amount because this is your liability. The judge can giving you relaxation by paying the said amount in instalments and not in one time. But if any of the instalment will not pay on time .. , the suit under section 138 is run again against you.

The consequences will be as such
1. Two years imprisonment and
2. Fine of double amount of the cheque in issue. But there are certain provisions to delay or to tackle such situations. Contact if u wish to resolve this.

Sir last option under the act is to put the defaulter behind bars but the one option is to talk with the drawee and make installment of payment every month or as per the convince celebrity as per the settlement between both of you..
