My sister mistakenly gave more then 10 lakhs to her boyfriend

08-Sep-2023 (In Cheque Bounce Law)
My sister gave money to her boyfriend which was around 10lakhs on the pretext that his mother was gravely ill and needed money for her treatment. To be on safer side my sister asked him to give her a blank cheque which is properly signed and my sister name's written on reciever's column but no amount is written on it. Last week he started to ask more money which obviously sounds like a fake reason which led my sister to believe that it was lie all along. What can she do to make sure that she receive all that money back. Please help as she didn't think of situation maturely and its a large amount of money that is at stake.

your sister can use the cheque by filling the same for the amount she owns against the said man. then present the same in her account and see if the same is honoured or not. if not she can file complaint against that man for cheque bounce...

If your sister is now out of influence of her boy friend and want to recover her money then she should fill these blank cheques and present them in the bank and recover her money back. BUT if these cheques get bounce then she should immediately engage a lawyer n send legal notice to her boy friend to pay back her due amount AND still her boyfriend ignore all this then she should file a case u/s 138 of Negotiable instrument Act in the court.

for the reason of his bona-fide intention ask your sister to encash the cheque amount. the person has barely handed a piece of paper. the cheque is for the gurantee that the issuer of the cheque has the amount in his bank which can be encased through this negotiable instrument. however, if he would have that cash in his bank there was no need of demanding such a huge amount from your sister.
if your sister can use the cheque of the amount which has been given as loaned money and on the occasion of dishonor can file cheque bounce case against the person.
