my opponent failed a cheque bounce case against me

I issued a cheque to a person and later I found that I need not to pay that much amount to that person. I have issued a lawyer's notice to him and asked him not to deposit that cheque. But that person deposited cheque and filed a court case against me without giving a reply to my notice. can I win the case on this point?
hi if he had filed cheque bounce case in the court without issuing any semand notice or any legal notice then you could defend such case and counter such allegations and also file quash petition to quash the case
