Mutual Agreement for Recovery of Loan

I had lent an Amt XYZ to my close Friend and had taken written Agreement & Cheque for given Amt. He failed to repay within agreed period. I presented the cheque which was dishonoured (Insufficient Funds). Now my Friend is ready to repay the Amt on monthly basis alongwith one fresh Cheque for which I need Mutual Agreement. Could you please me as I'm a Senior Citizen and cannot move around.

sir you can accept that new cheque and accept the part payment by making a new agreement or you can send a legal notice and recovery the money by filing civil or criminal cases
or if you don't want to lose friendship you can take the amount partly

Dear Sir,

Cheque is the strong document and better take it in blank so that anybody on your behalf present the cheque and get it bounced and then file cheque bounce case. Further, mutual agreement may be drafted on e-Stamp paper of Rs Five Hundred. Take signatures of two cases on such agreement.
