You can proceed legally for the recovery of the loan amount by filling the recovery suit or if you have a cheque then cheque bounce case. If the person is not from India, You have to service the summon at the place where that person is residing outside india. You are advised to provide complete information and details of the case to have the exact remedy of your case.

loan recovery from NRI , there are no sufficient facts in your questions . If you have a cheque issued by him. If the cheque is dishounered you need to send legal Notice as per the Negotiable Instrument act, After the legal Notice, if he had not paid then you can file cheque bounce case

First of all rather than going legally you should serve him/her a legal notice and in that notice you can write that either pay my money or face legal action which will be at your own risk. After that if he/she fails to give you a satisfactory reply then you can anytime file a recovery suit in the court to claim your money back along with compensations.

hello, you can send Legal Notice to the borrower via email as well as to his last known location in India and the country in which he is a resident off. To file a suit, you have to find which country he is residing, several countries like UK, UAE have reciprocal agreement with India. That means Indian court's decree can be executed in that country. You can file a summary suit U/s 37 of CPC and in case the cheque is bounced you can file U/s 138 of NI Act.
