Loan amount and the person how took not willing to pay

A person took a loan of 4 lakhs rupees with 5% interest rate before 4 months on 25/05/18 now his is saying that he wont pay the principle amount and interest, i have his cheques and promiser note with his signature, pls sir or madam can say how to slove the problem to get money

Hello sir, For this you need to bounce the cheque or you can also give recovery notice first only if you don't want to proceed with criminal case but if you bounce the cheque you have both options. Hi 1) You can present the cheques in the bank and file case under 138 Negotiable Instruments act. Please note Negotiable instruments act is a criminal offence and the person has to pay the money along with fine , failing which he will go to jail. 2) In order to recover the money, you will need to file a money recovery suit in a civil court and ask for attachment of properties. So technically you should file 2 cases.
