Liability in cheque bounce case
23-Aug-2023 (In Cheque Bounce Law)
I had received a cheque for discharge of liability, against sale of land to two persons, in lieu of a GPA. But the cheque has been returned unpaid due to insufficient funds.
The cheque was signed by only one of the two buyers. However, the GPA has the name of both persons and an additional affidavit was given to me by them stating that they have given ch. no. ________ against the balance payment of the land sale. Reference to GPA has also been given in the affidavit. Please advise if both case of cheque bounce can be filed against both parties (one case only)
Cheque bounce case can be filed against the person who has issued the same. However recovery of the amount can be claimed by both the parties through civil proceedings. Further we can file a suit for specific performance and get the amount mentioned in the GPA. For better advice please feel free to contact.
Thanks
