LEGAL NOTICE UNDER NI 138 (Complaint Matter)

Does it create any issue if an advocate sent a legal notice to the defaulter but when it comes to filing the complaint some other advocate signed the vakalatnama?

No…there’s no hard & fast rule regarding this. The advocate who has sent the legal notice can be different to the advocate who signs the vakalatnama and represent the client. For more legal assistance I am just a call away.

No not at all it's absolutely the wish of the complaint with whom he want to go with. But Ni act needs technical grounds to win the case . Notice is mandatory for filing the case of N I Act. keep the bounce cheque and return memo from bank.

Hi..!!
No this won't create any issues as such. It's totally fine if you change your advocate. It's your right, you can anytime exercise it.
As it is legal notice and complaint are two different pleadings.

no it doesn't make any difference... you can choose two different advocate one for notice other for complaint....there is noblegal impediment in the same .... case has to be as per procedure established by law

It doesn’t matter at all ! U can change end number of advocates via new vakalatnama & informing previous advocate about it ..! We need more facts on the case ..! Thanks n b in touch to understand the legalities of 138
