Q: Can 420 FIR be quashed in HC, Complainant vanished after settlement.

After a 420 FIR against us, we had settled the matter in mediation while taking AB. We did not know we had to quash the FIR also. Now the trial has begun and complainant is not appearing even after summons through ACP, DCP, SHO. Judge is asking us to fight on merits now and argue on charges. Filed quashing in HC, judge has summoned the builder but not staying the trial as it could lead to findings where we could have done any forgery in MCD. Private Land is involved. What should be done?

Hi sir.. !!My suggestion to you will be that file an application seeking discharge from the charges and while arguing the said application put forth the fact very strongly that when the complainant is not interested and not coming to the court despite specific court orders then the present case should get dismissed.



Q: Divorce mahila aayog counseling

I filed for divorce after 1 year of seperation, under section 13. So after 2nd counseling wife filed complaint in mahila aayog. But in mahila aayog results got in my favour, so again my wife filed case on my mother base on dowry.So whether filing multiple case in mahila aayog is legal? Can I put this in Court by application?She is torturing me & my relative so how I stop them?

Hi..!!Sir first of all Mahila Ayog is no court of law. Those are just mediators who tries to resolve your family issues so that court cases can be avoided. If your wife has filed any case in court then she can file no one can stop her. However you should fight that out as men are being harassed on the pretext of false cases.



Q: Delivery guy took away the money I paid for COD

I got a package of~3k from Ajio via delhivery via COD. I got the package after payment but had to return the product due to sizing issue. Turns out delivery guy ran away with the payment and that's why it showed that it was undelivered for weeks. Eventually ajio took back the product & refunded me. Now delhivery made me sign on a document about the "loss" & recorded a call making me say I received it (I mentioned both times I paid for it too). Will they try getting money from me?

Hi .!!!You should protect yourself from these things or any adverse situation.You can give a legal notice to Ajio or a mail giving in writing the entire story so that they don't misuse any fact in future against you.



Q: Eviction from the Pagdi System

We have a small shop in Chandni Chowk from the past 30 years which is under the Pagdi system. I want my son to take over the business there but the landlord wants to buy that property out at a price lower than market value. I don't wish to sell it but I want to know my rights regarding the same.

Hi sir..!!You have purchased the shop on pagdi or you are on rent on pagdi. There is a difference in both the things. Your question says that your landlord wants to buy means it's on rent. Please give clarity on the question so that it becomes better for us to answer the same and give you right advice.



Q: Live in relationship without divorce

I am fighting my matrimonial cases (DV, 498A, Execution, Crpc 125) for more than 7 years. Can I go for live in relationship with a widow woman without facing any legal problems ?

Hi..!!Legally you cannot live with another women if your matrimonial matters are pending. If you will do so then that will be considered as adultery and/or cruelty on your wife and if she find out this and gets this before court she will take a lead on all the cases.
