Legal notice not received............

sir i given my cheque to friend for a loan amount of Rs 150000 five years back, and he received every month 4500 like interest amount. i given 39 months and once 33000 total 2,16000 he received from me. since 18months i did not paid anything so now he send me a legal notice by regstr post but i did not taken that so plz tell me the way how to solve the problem.

You issue the legal notice counter to that and you. Receive the notice don't fear give the reply after that we can see any legal step they have taken like we havre to do you take my no I can tel what 7406722590

He might have presented your cheque at bank and that would have bounced, hence he has issued a legal notice through advocate for the offence punishable under Negotiable Instruments Act 138. Next if you receive any notice means you have to receive and attend the court through your advocate to defend your case otherwise warrant may be issued against you, if the other party proves before the court that you are staying in the address where the notice was sent. You have mentioned you have given the money to your friend back if so what was the mode of payment you have done if it is through bank or cheque then you can prove your case in court that you have repaid your money and he has not returned your cheque.

If your ignoring legal notice also they can go to the court and file criminal case against you. it is a criminal offence then you need to fight in court for which time duration will be more. so what i suggest you instead of taking legal step get settled the matter out of court and clear the matter by paying back his money.

Dear friend,

First you decide that genuinely you want to pay back the money with interest or Not,
if yes --time bound that you want to return money after 1 year 2 year 4 years etc.. for that solutions are there,
If No--, there are several ways, nothing to worry,
You should prepare your mind, that you are not received money rather you have to receive money, that cheque which you have given may be security cheque…….etc,
You can do lot of things, even you can claim money from him legally,
That cannot be disclosed in this mail,…….
