Is NI Act applicable to foreign Currency cheque bounce in India ?

I have a cheque issued to me in a foreign currency . Can I use this cheque to drag the issuer of the cheque to Indian Courts under Negotiable Instruments Act ? The cheque is issued by the director of a company who has registered office in India. They have a branch office abroad , and the cheque is issued in the name of the abroad branch office. They are avoiding my calls now as they do not want to pay me . I checked up with the banks and they are ready to accept the cheque in to my Indian Accounts. The transactions were done with the abroad branch office when I was abroad.
yes. the liability is there and the 138 nia case can be filed here in india as per your bank branch. it will depend however that the repayment was agreed to be made as per your cheque in hand. the law is that where the branch of the complainant is there case can be filed
Case under Secion 138 Negotiable Instruments Act can be instituted where the Drawee i.e. you are maintaining and operating your Bank Account. So, If you have opened up a bank account in Delhi, lets say in Model Town, then you can file your case under the aforesaid Section according to Model Town Jurisdiction.
