In any complaint case or in your matter you have to file in High court after taking permission under leave before the same. This is specifically for 138ni act. After 2008 amendment in CrPC 1973, an appeal can be filed instead of a revision in the same court in which appeal against conviction would lie in case of conviction of the accused. Therefore, the more proper and effective remedy of appeal is available to the complainant instead of the less effective remedy of revision.

the cases under 138 N.I Act, if the accused is acquitted by the court then you have only one option, that you have to file the appeal before the Hon'ble High Court. but in case if the court held guilty to accused then the accused have a right to file the appeal against the impugned order before the Session Court.
