How to recover loan lent to a friend

Hi One of my collegues called me up and asked for money because he had some family emergency. I had transferred the money via bank transfer into his account. When i asked him to return the money he issued me a cheque. However that cheque has bounced. Collegue of mine is not picking call nor he came to office. How should i go about this situation. There was no written agreenebt but i did transfer the money by bank transfer. Kindly help me..

You can sue against your friend in case under section 138 N I Act and there is time limit after dishonour of cheque you should issue legal notice through advocate calling upon that he return the money within 15 days and after expiry of 15 days u can file case

There is only way our to file suit for recovery before the court and recover your money if your cheque within the limitations of dishonour then file complaint under section negotiable act. This is the

You can file a complaint case against him u/s 138 N.I.Act.your loan is a friendly loan and you have a proof of bank transfer.so you can do the case.and if you have any query plz consult us.

First of all give the legal notice to him and demand the money which is payble by him, then file the complaint case under section 138 of negotiable instrument Act, you don't have to prove more, burden of prove on him because he has been issued cheque for payment.

There is no need for any agreement as the issuance of cheque itself would suffice your cause. You have both civil and criminal remedies to recover your money. Send him a legal notice of demand within 30 days from the date of cheque bouncing I.e. dishonour, asking him to repay the amount. If u fail to do so, then u lose ur criminal remedy and only a civil suit would have to be filed which will include a court fee.
