You should file a Civil case for cancellations of these documents as soos as possible. The criminal case doest not give you more relief regarding the property. The Civil case should be file within 3 years from the date when you get the knowledge about the document executed by your brother.

Q: Can daughter in law claim share in property if it is self acquired

Sir I am 56 years old, I had 3 sons, currently one of them has committed suicide. He had 2 children and wife, now his wife is demanding the property from us, and I have all property on my name and properties are not ancestrol one. Pls tell me legally can she claim the property from us in this condition?

Advocate Naved Azam answered
She or your sons can not claim the property in your presence. You should file a civil suit against the her and you have right to live alone or with anyone because you are absolute owner of the property.

Q: Procedure to claim share in mother's property

I am hindu and my dad expired in 2010 making my mother as receipent of his property. This was second marriage of my mother and third of my dad. I am from their final marriage. I have five other siblings from final marriage, and two step sister from previous marriage of my mother. Now as my mother has mutation done she wants to transfer property to her daughter from first marriage (my dad had brought up those 2 step sisters) as she is my mother favourite, moreover she has failed marriage so lives with us. Can mother transfer it expelling their only son?

Advocate Naved Azam answered
Need one clarification before reponding your queries that your father was the owner of the property or the document of property in favour of your mother. If the owner was your father dies without making will then your mother can not transfer the property in favour of her daughter alone. Property share will give in favour if all legal heir.
