How to issue NBW, Accused did not recived back Bw.
05-Apr-2023 (In Cheque Bounce Law)
I was raised case 138 Ni act 4 years completed but accused didnot present in court. Still 5 time B/W issued but court not issuing Nbw, magistrate says that bw did not received back by accused so we cant issue Nbw. Case in dwarka court and accused from bihar.
hello client as i can see ur issue is really a head ack i agree as the judge is saying tht he can not issue nbw to the accused it does not mean tht corts do not have power to do so . in these matters courts have full power to do so if judge is hesitating in issuing the NBW in that matter we nees to get him bind with directions of the superor court so tht ge is not at all able to fevour or give benifit yo accussed.
