How to be saved from being falsely prosecuted in a cheque bounce case

already a untrue NI 138 case on me on basis of blank signed cheque and 10x amount written thats not my handwriting on name or amount or date and its not proovable as i think due to the complaint has given my mother money through bank..my mother is not alive.. and he get my blank cheque after a year and claiming that i given him cheque because he lost money from mom and he write 10x amount that he give through bank..but i fear that still his freind whose payment is cleared by dad have my blank signed cheque that he can use in future to blackmail..should i complain in court in this past case or what to do..i am not sure his brother have it or not but i doubt that 2 cheques were stolen from that i realize later so shoul i complain about this 2nd in running NI case?or what to do?

I have perused your query. Can you please elaborate the facts a bit more clearly? Also, please answer the following questions:

1) Why do you think the forgery can not be proved?

2) When was the money given to your mother and for what purpose?

3) When you say that the amount given by your Dad to him is cleared, was it to repay the amount given by him to your mother? Or

4) Do you mean that the friend had extended financial help and the money is returned by your Dad and is settled?

5) Was a legal notice served upon you, demanding the money given to your mother?

Answering your question,
- Please file a complaint with the police authorities regarding the forgery as it is a criminal offence. You can produce a proof of the FIR in your ongoing NI case and also initiate separate criminal proceedings against the person you think has forged your signature and to stop the friend from misusing it in future.

Please go to your bank and give one letter to them to stop payment for that remaining cheque. Specifically mention in that request letter that you had given blank cheque towards security and now you don't owe any amount to them.
Further, also send one legal notice to the person who is holding your cheque through your advocat and ask theem to return that blank cheque as now you don't owe any amount to them. Pl specifically mention word BLANK in letter to bank as well as in legal notice.

Firstly you can file complaint for forgery and false signature before the Court.
Further file compliant for missing of the cheques to ur nearesh police station otherwise
close the accountas your mother has passed away.
