Once the cheque has been bounced you should send notice withing 15 days from the date of cheque bounce and after lapse of 15 days you can file complaint case within one month.

once the cheque is bounce you need to immediatley send a legal notice and then file a case at appropriacte court having its proper juridiction ....

The case can be filed under section 138 even if the cheque has bounced once but then there should be a legal notice sent through an advocate to make the payment within 15-30 days and if still payment is not made within date time you can file the case after expiry of 45 days from the date of legal notice.
