Gave blank cheque to bank for loan can they file a cheque bounce case

We took a agricultural loan from bank.we gave empty cheque to bank.now unable to pay loan.Can bank file case against us after putting cheque under ipc 138.Is it a bailable offence? Give some court decision links with your value able andwers

Bank mostly take Blank Cancelled Cheque ( only one ) for ECS purpose only , not for clearing ., If you are/will unable to pay loan, Bank will opt methods for recovery of loan amount .,., not for 138 N.I. Act

yes bank has the power to do that rest there is no need to worry regarding the kindly give the exact details then will be able to help you in a proper way rest because only after we know to help you it will be easy thank you

Your case requires thorough review of loan agreement to know whether bank took this cheque as a security or is misusing it against you. I said thorough study because section 138 of NI Act (not ipc) is a performa litigation where courts usually convict.
