31-Jul-2023 (In Cheque Bounce Law)
Hello, one of my friend have opened a Pvt ltd company ( 1 year back) and he took a hotel on lease which was bounded with his company, to run that hotel I gave him 10 lakh online for partnership on his personal account, but after 5 months I came to know that he was doing fraud Nd he was not even giving me partnership docs , he has given me a share transfer docs even that docs r not up to the mark I mean literally fake. Now to end up all this , I have taken 3 post cheques of 10 lakh, but now am afraid that his signatures are not correct. The first cheque date is 1 Dec . So what will happen if he will file a complaint about his lost cheque to play with situation and what will I do then ? Suggest me please

Hi,
You have the documents with yourself which your friend gave ?
It's hisegak liability to return you the amount in question.
Give him a legal notice mentioning the cheque he has given.
For more information feel free to have a word with me.
All the best

if the cheque particulars is filled by your friend in your name than there is no issue of like this matter, and also keep safe that fake share certificate with you as it would be needed in case of cheque bounce, whether the cheques were given by him in presence of other person it would be important.

Dear Sir,
You should immediately file a police complaint regarding the same. In the meantime, you can also sign a compromise deed with the other person so that he can not file a complaint for lost cheques
Even if the signatures do not match, he will still be covered under sec138 of NI Act..
