FIR filed for loss of Cheque, now claimed by someone else

Hello sir , my father has already informed the bank abt the loss of cheque and he has bank documents as well with seal and written statement as well. My father has also infomed police regarding that and has affideveat regarding that. A person is now claming the check and filled an amount of 3 lakhs . He has sent us notice regarding that. What should we answer for that ?

Hi,
As you have received demand notice regarding cheque bouncing and you are telling that the said cheque lost and misplaced and someone has deposited it without your consent and got it dishonoured. Do you know the complainant? What is the legal liability he has stated in his notice?

However you can reply the notice through your advocate and deny all allegations as such no cheque was issued by you in discharge of any liability and also by defending that you have proof that you have never issued cheque and already have lodged complaint about misplace of complaint.

Definitely they will file legal proceeding in the court within 1 month and you have to defend that.

For proper suggestion I want to see the copy of F.I.R. , Affidavit made by your father and legal notice received by you then I properly told you that what reply should be replied to that concern person ....
Or if you are interested then I draft you legal notice on that behalf

You cannot stop the holder of cheque from filing a case against you but you should get a reply notice issued stating the fact of loss of cheque and subsequent steps taken by you in that regard by calling upon him to desist from initiating false case. Your reply notice, Banker's endorsement on your and your affidavit before Police will help you in getting acquitted.
