Filing a money recovery suit in a cheque bounce case
29-Jan-2025 (In Cheque Bounce Law)
Respected advocates, I received a cheque from the buyer of my land for 23 lakhs that bounced in Bangalore. Transaction happened in Tumkur district. I'm planning to file a money recovery suit that includes interest as well. Transaction took place 7 months ago as of today. How much interest can I practically expect from this suit and can I file this suit in Bangalore, as I'm residing in Bangalore?
Dear Sir,
You can file cheque bounce case in Bengaluru because it seems it is bounced in Bengaluru Bank, if it is time limits. Since transaction took place in Tumkur and probably documents might have been executed in Tumkur so you have to file a case in Tumkur Court only unless you have any other document to justify to file the case of money recovery in Bengaluru. The Civil cases go for four to five years in rate of interest normally will be allowed as per Bank rate only.
yes absolutely, you can file recovery suit in Bengaluru, you could have filed cheque bounce case, because in civil suit you will have to pay court fee on the money which you claim, for eg. for 23 lakh court will come around Rs. 1,17,625/- and it has to be paid via DD and DD has to be drawn in the name of Registrar of City Civil Court Bengaluru.
