Father paid the loan amount person still sending legal notice

dear sir/mam a friend of mine has filed a case against me owing him 2 lakh, but i owed him 40,000 which my father has paid to him through neft payment he has sent me a legal notice to my address informing me to put a case under sec 138 of NI act please advice me on this matter.
Give him a proper reply through a Advocate and details of money u taken and you made payment how much u taken.u have keep all the documents with that regard of ur transsaction .what documents u have regarding ur transaction

Have you given your undated cheque to your friend without mentioning the amount ? If you have given then you have committed an blunder. When did you give your cheque and taken the money ? If it is after demonetization then you can take a contention for example if your friend says that you have taken money in the form of cash then you can say it as false as it is more than Rs.20,000/ it has to be given through cheque or account transfer , hence his claim becomes unlawful and you can say you have never taken. If you have taken before that then you have to contest the case as you have given your cheque otherwise you should have some strong evidences to prove that you have taken only 40,000/ if your father has transferred the amount taken by you then why didn't you take your cheque back or issued notice to him to return cheque. You have to face the case.
