Eligibiligy of the candidate to get visa if any legal cases are there.

Dear sir
if any CC case is running and issued summons is he eligible to get visa
for abroad to work. please clarify and reply to mail sir.
The candidate did not receive any court notices and did not appear in the court infront of judge till date as he is out of station.
even though receiving the summons wont curtail the person to go abroad and only when there is a conviction is against him and an appeal is pending then only he is forebidded to go out of country until completion of the sentence period
