Court summon received under section 138 against loan
16-Sep-2023 (In Cheque Bounce Law)
I have a court visit on Sector 138 on Monday for the loan cheque bounce on a continuous basis. But every month on some other day, I used to deposit cash as well at the equivalent amount of the EMI. My total loan o/s is rs 33,000. Can I take the money to the court and ask the judge that I was not aware of this notice, since my address was changed and mobile number is also changed. I did not update my new address and number with HDFC. Can I pay the entire amount in the court ? Can I expect the judge to agree to me and then the judge cancel the warrant ? If the warrant is cancelled, then will it ever be reflected in my Criminal history check or new job background verification ?
Yes you can pay the entire outstanding amount to court and pay the bank there itself. Court will not only cancel the warrant but also will end the case there itself by recording the statement of both the parties. It will not affect your job prospects in future.
It is not clear from your question whether you have received just summons from the Court or warrants of arrest have been issued against you. if it is the former you could simply go to the Court and pay up. the offence being compoundable can be compounded. Since it would be the very first hearing you may not be required to pay any compounding fee separately and the case will be simply disposed of and it wont be reflected in your records. However if it is the latter you will need to be a bit more careful. The notice will have to be seen and action would determined depending on whether warrants issued are bailable or non bailable.
