05-Nov-2023 (In Cheque Bounce Law)
I am working in a recruitment firm and they people are not paying my salary.they give me one cheque that too got bounce.my 3 months salary is pending there
You should immediately serve them a legal notice asking them to release the arrears of your unpaid salary and as far as the bounced cheque is concerned, you may use this to pressurize the co. Incase even after sending the legal notice they fail to do the needful. In that case you may file a cheque bounce case and case for recovery of Salary.
as far as cheque bounce is concerned you must send notice within 30 days of intimation of cheque bounce from your bank. if you do not send notice within 30 days you will no legal remedy regarding cheque bounce under 138 negotiable instruments act. for 3 months pending salary you can approach court for recovery of money. the court depends on the nature of your job and salary.
In case you are still working with the firm it would be best that you first give a written request to the firm I intimating them about the cheque bounce and requesting them to clear your dues at the earliest. There after if they still do not clear your dues or give a valid reason for non payment then you can send them a legal notice demanding clearing of dues at the earliest
