CHEQUE PAYMENT FROM BROKER BOUNCED

22-Aug-2024 (In Cheque Bounce Law)
A property Broker had given me a cheque to return my booking amount for a property booked through him after I did not go ahead with the booking. This cheque bounced with memo stopped payment by drawer. I have been defrauded. What legal action can I take now. The check will complete 3 month validity on 31st August

First you should contact your local lawyer and send a notice for dishonouring of cheque. You can also initiate a criminal proceedings against that broker in court or can file an FIR.

You can file a case under Section 138 of the Negotiable Instruments Act for cheque bounce, which is a criminal offense. Before that, send a legal notice to the broker within 30 days of the cheque bounce, demanding the payment within 15 days. If the payment is not made, you can file a complaint in the court within 30 days after the notice period ends. Additionally, you may consider filing a case for fraud or cheating under IPC/BNS sections.
