Cheque given which got bounced what are the next steps possible

17-Aug-2023 (In Cheque Bounce Law)
How to proceed with check bounce issue under Section 138 in The Negotiable Instruments Act, 1881. Someone owes my father an amount of Rs.50000 and is evading payment for long time. After many follow ups, he has given a check of Rs.25000. When my father went to the back with the check, it was dishonored as bulk amount of cash was withdrawn from the account previous evening. How to tackle such case. Thank you.

See the valadety of the cheques are for 3 monthes so you have to present the cheque within 3 monthes and after presentation of the cheque if it gets dishonoured then the bank will give you a statement and reasons for dishonour there after dishonour within 30 days issue a notice of demand thereaftre 15 days if no payment is made then within 30 days file a case within 30 days thereafter where the drawee bank is situated
