cheque given by me as security bounced. Whether I am liable.

In a private transaction between my two friends I stood as gaunter and given surety to one of my friend. I issued a cheque for rupees two lakhs duly signed by me but it is undated. Now I am receiving threatening calls that he will file cheque bounce case against me if I do not pay the above amount.

Hi,

If you are getting threatening calls please Approach nearest police station and file a complaint. Cheque bounce will only happen if your cheque is dishonoured. Please act fast file a complaint jn police station and rest police will take care.

Yes, he can file a cheque bounce case against u by using ur cheque, but u can successfully defend the case if u have sufficient evidence to show that the cheque is not given for legally enforceable debt n only as guarantee, it depends on what best evidence u have..

You contest the matter, if they are threatening, you file a cse against hilm . If it is genuine young settle out of court, otherwise, if they sent you legal notice then you consult me to put up the reply. Consult more.

It is your responsibility to see that cheque amount is paid. If you fail, you are liable for civil and criminal action. Pl be careful whenever you issueshould cheques with your signature. Presumption would be raised, it is upto you to rebut the same.

As a guarantor cheque Case not sustain against you, but he will never file a cheque Case against you for issuing cheque as guarantor on behalf of your friend
So better receive back your cheque or other wise you have to face consequences
