cheque fraud case opposite party not willing to pay my amount

opposition party given cheque for 70000 rs but the cheque get bounced . please suggest me can i file a case of section 420 non bailable.

You can give a complaint against him for cheating as well as you can file a complaint/case against him before Magistrate Court under section 138 of Negotiable Instruments Act,1881. You have to first send a legal notice against him and then you can proceed filing complaint and case against him.

After return of the cheque you have to issue statutory legal notice to the party. you can file 138 case against him read with sec 420. You can get warrant from court and do the needful. If you have any questions please feel free to contact me. I'm Venkatesan Advocate from Chennai.
