Dear Sir, for invoking jursidiction of Court, you have to explain where you deosited the cheque given by the concenred guy is material. If you provide documents it will be easy to advise you. Thanks and Regards
hello how are you will get easily your money first of all what you have to do you have to issue the legal notice under section 138 that is demand notice that is a mandatory process and once you will issue the legal notice to you have to wait for 15 days and after 15 days you can file the complaint before magistrate in Pune also there is a new provision in law as per section 143 a you will get the 20% of the cheque amount at the initial stage only.
sir if the cheque has bounced it is required of you to first give the requisite notice as mandated under the provisions of the negotiable instruments act..do not miss the dead line of giving notice..once you serve the notice, he will be required under law to give you the amount as bounced in the cheque failing which we can go ahead and a file a complaint against him in the magistrate court.
