if you have issued a legal notice demanding the money then you are at liberty to file a 138 Negotiable Instrument Act case within 30 days. bouncing of cheque due to signature mismatch amounts to criminal intent. apart from 138 Negotiable Instrument Act I would highly recommend that you also file a money suit to claim the money. if possible attach any office property to ensure that your money is recoverable at the end of the day.
