Cheque bounce case for a Defaulter party

Hi, I had filed a legal suit against a cheque bounce that was issued against a payment of goods provided to a party. The defaulter has submitted a case in NCLT to get himself defaulter tag. Just wanted to ask what happens if the NCLT court gives the party a defaulter status. Can I still continue with my criminal suit. -Regards, Aman 7028024452

it is better you can your lawyer who filled your case he may have better understanding of what your position is on this case. you can revert back to be if you want I should work on your case. I will make sure your all legal right s are protected. Thanks

YES you can very much continue with the criminal case filed as proceeding u/s 138 doesnt come under the purview of Sec 14(1)(b) of Insolvency & bankruptcy code thus proceedings under ection 138 NI Act can thus continue even after initiation of CIRP.
