Cheque bounce case against father even when cheque is issued by son

My elder brother issued a cheque to his party which later on bounced due to account closed with bank. The party has filed case against my brother and father even when the cheque was issued by my brother from his personal savings account. A. How is it possible to even register a case against my father. B. Can we go for defamation suit against party for defaming my father.

legally it is not maintainable and you can proceed to claim fir defamation against this party bcoz legally only person who issued cheque is responsible for it's bounce and if your father is prosecuted wrongfully thanyou can claim damages

yes only thoes person liable for this who issued the cheque so when this complaint will file in the court its may b declined,refused so don't worry
second yes you can file a defaming case against them

if your father has been summoned by the concerned court then first of all you should file a revision petition against the summoning order in higher courts like District & Session Court or in concerned high court. Thereafter you should send a legal notice to the person who filed case against your father and seek apologies from him. if failed to apologise then file suit for defamation against him under section 500 IPC.
