Cheque Bounce But Party Died Who's Issued Cheque what to do now

My father died 2 years back but one party filed cheque bounce case against us stating that your father has taken money 1 lac long back but not paid. We were not aware of it. Last time he's sent notice but we family members were out of sation. Now summon has come from court police are telling there is arrest warrant. Kindly guide How to face this as my father died long back and complaint against legal heirs. One more thing party is teling that your mother has signed in cheque as security . But it is single account.

If the cheque was that of your father, the case against him cannot go on if he is not alive. You have not stated who has signed the cheque , but if it is of a joint acocunt bearing one more signature you will be liable.

When it s a single account of father u have to prove the case since summons have been issued by court, court does not know about it and it has to be known only when u bring it to court knowledge by taking bail contesting case do it.

Dearcsir/Mafam,
If that cheque belongs your father and they can't file cheque dishonored case against family members before magistrate Court but they have option that they can file recovery suit before civil court.
