If cheque dishonor is willful, the defaulter can be prosecuted under Section 138 of Negotiable Instruments Act, 1881 or Sec 417 and section 420 of the Indian Penal Code (IPC) 1960. Under Section 138, the aggrieved party may send you a legal notice first. If you are found guilty as a willful defaulter, you can be punished with a prison term of two years and/or a fine as high as twice the cheque amount.
