Cheque Amountbis Lower Than Actual Due

I am accused in my case. In my case at cross of complainant stage I found that applicant had not credited all my claims which he liable to credit in my account as per there mail from official mail id.. if court consider my point then actual due comes down than the blank cheque utilised and filled by themselves. If cheque amount is lower than actual due then can I still liable for punishment in sec 138

Hi,

You need to prove that the cheques were blank cheque issued by you as security ,

You can ask specific questions regarding your payment ask for bank statement and balance sheet of the firm .
If you have made part payment , complainant cannot claim full amount .

if your defense are credebile and you also proved the your defense through your credebile documents/ witness thereafter the consider the your case and acquittal to you in your negotiable instrument act under section 138 .
