Can i file appeal if case dismissed due to identity issue of accused


13-Sep-2023 (In Cheque Bounce Law)
case acquitted as accused not shown while sending notice. ps firm name only notice sent. court says identity of firm with accused not established. can we appeal. now i know other partner (wife) signed the cheque. thanks

Yes you can go for an appeal ... To higher court .... As you got the identity very late now in the appeal you can show the relevant documents ...
File the petition before the period of limitation period expires

Is it contains the date, you have to check and present it before bank then after once it get bounce within 30 days you have to issue the legal notice to the other side through your advocate. You can file by seeing the validity of the cheque date otherwise you can also file for money recovery suit at civil court.

you cannot file an appeal against a party who was not made a party in the earlier proceedings. moreover under the N.I act you have to issue a notice and also give 15 days time to make payment and in this case you have not issued notice so filing an appeal against that person may not be advisable. if the claim is within a period of three years then you can file a civil suit for recovery.
