Borrowed money person threatening to file cheque bounce what to do

10-Sep-2023 (In Cheque Bounce Law)
I had given a blank cheque to a lender for Rs 1 lac through my mother for my sisters marriage. Having said my mom had also taken some money from the same lender earlier for Rs. 2 lacs for business with no documents norn signed a bond. The lender has the custody of my cheque, nevertheless I have paid Rs. 1 lac by cash to the lender and as well has been payin interest for 2 lacs without a fault as he is know to us for the past 15 years. Now a rift, the lender is now pressurising us to pay 2 lacs as he is in need but I have requested him to hold on till month end so that I pay him 1lac and remaining 1 lac to be paid by next year. I also requested him to return my cheque as I have gaurenteed it for 1 lac and remaining amount was taken by my mother. He is threatening now to produce the cheque and raise a case if it bounces. Having said. I have blocked the entire cheque book in Jun 2016 as he had earlier threatened and the same was amicably closed. But now he is forcing us. What should we do?

You have not mentioned about the mode of transaction. If he has given amount through cash to your mother then the burden falls on him to prove about the same for giving as he has not executed any document. Hence deny that you have taken 2 lakh rs from him and contest the case. You have not mentioned when the money is taken if is after demonetization period then the creditor can't give the through form of cash if it exceeds Rs.20,000/- . Consult any advocate .
