Appeal in high court..............................
06-Jul-2026 (In Cheque Bounce Law)
If i file an appeal in high court after losing the case in session court for cheque bounce and if the appeal is dismissed can i refile the appeal in high court
Dear Sir
If your appeal is dismissed by the High Court you cannot refile the same appeal in the High Court again because criminal courts generally do not have the power to review their own final orders on merits according to Section 362 of the Code of Criminal Procedure Once the High Court passes a final judgment or order dismissing your appeal the remedy available to you is to challenge that dismissal order before the Supreme Court of India by filing a Special Leave Petition within the prescribed time limit
No, ordinarily you cannot file a fresh appeal before the High Court against the same judgment once your appeal has already been dismissed. If the appeal was dismissed for default or on technical grounds, you may seek restoration of the appeal by filing an appropriate application. However, if the High Court has dismissed the appeal on merits after hearing the case, the remedy would generally lie before the Supreme Court and not by filing another appeal before the High Court. The exact remedy will depend on the nature of the dismissal order.
