Q: In-Laws not returning the amount I have loaned them.

I had loaned a total of 1.7 Lakhs to my brother-in-law and Mother-in-law. I have been trying to recover this amount for past 2 years. I have tired to contact them through phone, however they have blocked me. I have tried through relatives , email, multiple trials on multiple platforms over the past 2 years. However, they dont seem to respect law. I am already divorced and I did not get alimony nor child support as my ex is jobless. I need to recover the loan given to my inlaws.

Advocate Sadanand G Kumbar answered
English Response:I understand your concern regarding the recovery of ₹1.7 lakh. You may have legal remedies to recover the loan from your brother-in-law and mother-in-law. First, preserve all available evidence, including bank transfer records, payment receipts, messages, emails, and any written acknowledgment of the loan. The legal procedure will depend on how the money was paid and the evidence available.A legal notice demanding repayment can be issued to the borrowers. If they fail to repay, a civil recovery suit may be considered, subject to the applicable limitation period. Since you mentioned that the loan was given about two years ago, it is important to act promptly, as money recovery claims are generally subject to a three-year limitation period, depending on the facts and the nature of the claim. Please clarify whether the amount was transferred through a bank or paid in cash, whether you have any written proof of the loan, and the approximate date on which the money was given. These details will help determine the appropriate legal remedy

Advocate Sadanand G Kumbar answered
Hello. The share you may receive in the property after your mother’s death depends on the nature of the property, the family members/legal heirs, and the relevant property documents. After examining the property and family details, I can explain your legal share and the proper procedure to claim it.

Q: I have a DIVORCE Document but need another court issued original

I have a DIVORCE Document of my Sister In Law, but need another court issued original/true copy of the same for submission to CGHS (Central Government Health Services)

Advocate Sadanand G Kumbar answered
You can apply to the concerned Family Court or the court which passed the divorce decree and request a certified copy of the divorce judgment/decree. If the original certified copy is already available, you can still apply for another certified copy for submission to CGHS. The exact procedure and required documents may depend on the court. An advocate can help you file the copy application and obtain the certified copy.

Q: Need to Understand before filing Divorce / Legal Notice

I am married for 14 years now. I am a Christian. I have 13 years old son. From the beginning, spouse had anger issues. If he gets angry, he will use cuss words very badly. Recently, when I was scolding my son, for not studying, husband was ignoring me and supporting my son. I got irritated and shouted at him also. Still he was ignoring me. I said, let's separate if you are treating me like this, for which he said, do you think I will leave you alive, u r cheating on me etc. Then, he apologized.

Advocate Sadanand G Kumbar answered
I understand your concern. Repeated use of abusive and insulting words, threats, and such behaviour over a long period can be serious in a marriage. Since you have been married for 14 years and have a 13-year-old son, it is better to first understand the complete circumstances before deciding about divorce. As you are a Christian, the applicable divorce law and the facts of your case should be examined properly. Please consult a family-law advocate and discuss the incidents, any messages or other evidence, and the safety of you and your child. If the threats continue or you feel unsafe, take appropriate safety measures immediately.

Q: Does Self purchased property need daughters sign while registration

Owner is 75 year old female and property is self purchased. Now we are trying to purchase it does the lady's kids signature is needed while registration?

Advocate Sadanand G Kumbar answered
No, generally the children’s signatures are not required if the property is self-acquired and the 75-year-old woman is the sole owner. She can sell the property herself, provided she is mentally competent and willingly executing the sale deed. However, the title documents and any existing claims or encumbrances should be checked before registration.
