AFTER CASH SETTLEMENT, EXPIRED CHEQUES CASE

I issued 3 cheques (in name of a miller) & gave it to my broker from whom i bought goods from miller. Due some reason he insisted paying in cash(didn't took any receipts) & i paid. I failed to collect my 3 cheques but made them stop. My broker didn't paid miller the cash but After cheque validity expired, these cheques were given to miller for collection & he obviously failed to encash them. Niw miller is challenging me to court. What options so i have & how to proceed? I am Based in Delhi & Miller is in UTTRAKHAND

Hi first of all what happened when was the Cheque been given
And all what did he say and all how much was the cheque and all for
What did he say for paying the money and all u have to right to send him a legal notice and file a case of 138 of the act first file a fir against him in the police station

In this regard, i advice you to defend your case on the ground that the said cheques was issued on certain date for the payment of money which was valid for 3 months as i have already paid the same to the broker therefore there is no legal enforceable debt which is enforceable now. Furthermore, you can use the text messages and show evidence of payment of cash amount to the broker as there are various ways you can deduce if you have paid. you need to clear me as to where the said payee bank account is situated.
