Advance rent adjustment against security deposit

I had rented agreement for 24 months for renting out a flat. This is notarized. we have agreement to pay rent in advance. Now my agreement is expiring in march 2021 and owner want post dated cheques to be preseneted for advance rent of march 2021. As per agreement security deposit will be adjusted against any rent arreas. owner is saying to lodge complaint for cheque bounce. Can he do this . He has my security deposit twice than rent

dont worry dont give him any further security cheque, if you can send him legal notice for criminial breach of trust if uses your security cheques. For more detailed discussion you can contact me for the same.

Hello if you have given any cheque to the landlord towards the rent of the premises which you have rented out and the cheque bounces, landlord can file criminal complaint u/s 138 of negotiable act. Terms and conditions of the rent agreement are binding on both tenant and landlord. However if you have given any security cheque to landlord and there is dispute related to accounting you can inform landlord not to misuse and not to present the cheque in bank.

He can get the cheque bounced but you should get the payment stopped from the bank so that there is no misuse. Also I need to see your rent agreement and other documentation If any so that I can suggest your further course of action so that you are not faced with any cheque liability.
