Non delivery of service: Repair

I purchased a product from a seller In Gujarat through eBay. The offered warranty for 12 months through him as the manufacturer is in China. The product got faulty with in 12 months. He asked to send the product to him. Which I did. He has kept the product for the last two months and is now not answering my request to send back the product. How do I go forward. Do I have any legal recourse!!
you have remedy in consumer court or you can also file criminal breach of trust case agaisnt them but for best remedy you need to clarify few things to us about your product and documents with respect to same.please contact soon ,.
