Well, If Software Developer failed to deliver services to you within stipulated period of time if agreed between you, then you can file a case against that Software Developer in Court either to seek huge compensation for the loss suffered by you.

Dear client is there any legal work done between you both. any terms and conditions signed by you both. we can file civil case for damages but need to see all documents.

If there is an arbitration clause in the agreement please send a notice for invocation of the same. In the same notice you will need to nominate an arbitrator after this notice has been delivered to the other side they have to nominate an arbitrator of their choice following which the two appointed arbitrators shall nominate a 3rd arbitrator. If this was provided in your agreement. Following which we will have to move the HC under sec 11 for appointment of an arbitrator for the settlement of the disputes

You can issue notice to other side & invoke arbitration clause and call upon them to appointment/nomination of arbitrator. If they fail to appoint/nominate arbitrator, you can move high court for appointment of arbitrator.
