Anticipatory bail before FIR u/s 498A in u.p.-

Can I apply for Anticipatory bail or stay on arrest before registering of FIR U/s 498A against me and my family?? Is registering of case necessary for Anti. bail.?? it will be granted by district court or high court/

As per recent judgement of Hon'ble Supreme Court, Anticipatory Bail can be filed on reasonable anticipation or apprehension of lodging a cognizable report against the proposed accused. In your case, you can file an Anticipatory bail either at Sessions Court or at High Court directly by disclosing special reasons. However, you cannot seek arrest stay without lodging of FIR. It is advisable that if you have reasonable apprehension that you and your family may be booked U/S 498A then you can directly move the High Court and file an Anticipatory Bail.

In this regard it is to inform you that according to the provisions of the Criminal procedure code the anticipatory bail can only be file when any FIR registered against any person or any anticipation of arrest in any offence to the person who want to get anticipatory bail. you can get anticipatory bail from district court but if you did not susceed in getting bail from district court then you can file further anticipatory bail before high court also. So I am of the view that you should first apply for the anticipatory bail before district judge court only.
