Yes as it is a non-bailable offence, anticipatory bail can be applied for in the sessions court or the high court. Depending on the merits of tge case, the court will decide whether anticipatory bail shall be granted or not

Q: Onwer not returning back security deposit

Hi our rent agreement expired on 31 august 2018 and we vacated the house after that. The owner is refusing to return the deposit or give any date for return of deposit. what action can we take?

Sir give him a legal notice for recovering the deposit amount. Probably you will get ur amount at this stage. If he still does not r3turn the deposit amount, then u have different legal remedies like filing a suit in small causes or civil action by filing suit for recovery of money

I am singer nd actor i recently shifted in mumbai...mene 1lakh deposite kiya tha and 25thousand rent hai...ab landloard bol rha hai..ke aap khaali krdo aur 7months ka locking period tha...aur..yeh log ab bol rhe aap khaali karo...aur hum khaali bhi krrhe hai toh wo deposite nhi de rhe bol rhe h nhi dunga main...ab hume kya karna chahiye?

Sir/MadamYou can approach the nearest Police Station and file a written complaint against the landlord for cheating, criminal breach of trust and criminal misappropriation of property alongwith supporting documents to establish the fact that you had given the amount to the landlord.

Q: What to do if tenant not vacating the house

namaste sir,my problem is i gave my flat for rent on monthly tenancy .she occupied in month of August last year .she gave rent of August and September after that she stopped giving rent telling some one her family met with accident she gave money to him.everymonth same story .she pushed us threatned us we gave police complaint in the month of January.later she said she will vacate on march .she rejected thrice our notices by saying no body is residing in the house .we got wexed we filed eviction suite 15A petition April may was court holidays .on june first hearing next hearing on june next is july everytime she will come to court take next date and going nit given single rupee to us not deposited in court also .now she is claiming without proof she has given liquid cash cash to hand without proofs .may be she will get fake evidence what to do when will get our house back how long it goes.what is the solution my elder daughter marriage fixed we want house for personal use.

Sir/MadamI believe you have already filed a suit for eviction in the small causes court. File a notice of motion seeking urgent relief of possession of the disputed property for your daughter's marriage.
