Questions Answered by Advocate Vishakha Mangesh Jadhav

Q: Income affedevit n Rajesh vs neha case income details in affedevit

My mediation is failed as wife demands 1cr so I want reply from veterans what to fill in income affedevit to hon.court ..1)salary bank account statement.2) all individual savings account statement.3) " joint account "too where mother is primary account holder n me as secondary account holder 4) only salary slips plus salary bank account statement # I m govt employee

Advocate Vishakha Mangesh Jadhav answered
In divorce and maintenance proceedings, the Hon'ble Supreme Court in _Rajnesh v. Neha_ has mandated filing a detailed Affidavit of Disclosure of Assets and Liabilities by both parties. As a government employee, you must be transparent and truthful in this affidavit, as concealment can lead to adverse inference by the court. You should attach the following documents with your income affidavit: 1. *Salary Slips:* Last 12 months' salary slips from your government department. 2. *Salary Bank Account Statement:* Last 3 years' bank statement of the account where your salary is credited. This is mandatory. 3. *All Individual Savings Accounts:* Last 3 years' statements for all savings accounts held solely in your name. 4. *Joint Account:* Statement for the joint account with your mother must also be disclosed. Since you are a secondary holder, you must specify that your mother is the primary holder and the source of funds in that account. You should attach a note explaining that the funds are primarily your mother's. Hiding any account can be treated as perjury. The court assesses maintenance based on your net disposable income after statutory deductions, your liabilities, and your wife's income and lifestyle. A 1 Cr demand is not granted automatically; it must be justified with evidence. For drafting a proper affidavit and to counter an unreasonable demand, it is advisable to engage an advocate. Q: Petioner In Person Registrar Approval Received But No Progress In Case

On admission hearing court asked to take registrar permission to appear as petitioner in person on 23.09.25, i appeared infront of registrar and got approval via mail in october 2025, but case not moved since then, do i need to submit appribal copy to filing counter

Advocate Vishakha Mangesh Jadhav answered
Yes, you should submit the approval copy to the filing counter. When the court directs a party to obtain the Registrar's permission to appear in person, and the Registrar grants that approval via email, it is mandatory to place that approval on the court record for the case to proceed. The procedure is as follows: Take a printout of the approval email received from the Registrar in October 2025. Prepare a formal application or memo stating that the Hon'ble Court had directed you to obtain permission, which has now been granted by the Registrar. Attach the printed email copy to this application and file it at the concerned filing counter of the court.Once this approval is on record, the registry will list your matter for the next hearing. If there is still a delay after filing, you can mention the matter before the concerned court or the Registrar to request a date. Since the approval is already granted, non-filing of this document is likely why your case has not moved since October 2025.For further assistance with drafting the application and the exact filing process for your court, you may book a consultation through m LawRato profile.
