Q: Spouse right in husband's property.
Hi, My father has gifted me his share of property through gift deed. I'm going to file a divorce case. Is there any chance that wife can claim any right in the property.

Since the flat is now in your name it will definitely be considered while deciding to grant her maintenance/ alimony. Both husband and wife needs to file an affidavit of assets and liabilities. Thereafter depending on such affidavit, an order is passed. Since the flat is an asset you will have to mention it and the maintenance/ alimony would be decided on that basis.
Q: Whether to give monthly or ots ??
My wife DV in dec 2025 n I filed just now contested divorce..I m doing job n my wife no job n 3yr child 6 mnth marriage so I have some fear that if she takes ots n complaint to my office..(may be possible ) as I have some rare illness n some secret my ofc can enquire or may susp# me so if monthly maintenance I m thinking! How many yrs I have to pay monthly or still OTS is better ? I have 2 options monthly. Vs OTS.. as I have very best job I want to save it at any cost.

There is no straight answer whether monthly is better or OTS. It really depends on your capacity to make payment and the quantum of the amount. If OTS is involved, its less cumbersome since you pay her once and its done. On the other hand, monthly wise payment gives you flexibility on payment and does not pinch your pocket at once. We can discuss about this depending on the facts and circumstances of your case and thereafter a proper guidance could be given.
Q: Alimony recovery issue in court and husband is absconding
The court order and granted permanent alimony of 30,000/- per month. A Darkhast/execution case is pending to recover the unpaid amount. The judge is not issuing an arrest warrant because the previous address failed and a present address is required.

You can also file a Contempt Petition against your husband for not complying with the order. Since Contempt Petition would be filed before High Court, you will have better chances of succeeding and better implementation of order.
