Q: Appeal for Stay Order in Case of Dual Sale Agreements Executed on Same
I executed two sale agreements for the same property on the same day—one for ₹65,00,000 and another for ₹80,00,000. The actual value of the property is ₹65,00,000, but the sale was agreed at ₹80,00,000. I paid ₹5,00,000 in cash and obtained a receipt for ₹1,00,000. However, the court refused to grant a stay, stating that two agreements were executed on the same day. Is there any valid ground to file an appeal and seek a stay order?
Advocate Suryansh Shukla answered
Yes, an appeal can be filed but there is a serious legal risk. The lower court denied the stay because signing two different agreements on the same day makes the transaction look highly suspicious to a judge. Furthermore, since you paid ₹5,00,000 in cash but only have a receipt for ₹1,00,000, proving your actual payment in court is going to be very difficult. To get a stay from the appellate court, we cannot just repeat the same facts. We must build a strong legal explanation for why two agreements were created and legally secure your unrecorded cash payment. Please contact me immediately with both agreements, the receipt, and the court's rejection order. We have a strict time limit to file the appeal and protect your money.
Advocate Suryansh Shukla answered
Q: IS AN AGREEMENT WITH WIDOW OF YOUNGER BROTHER WOULD BE VALID ?
DEAR SIR I HAVE AN OLD HOUSE WHICH IS STILL IN THE NAME OF MY FATHER WHOH EXPIRED IN 2013 AND MY MOTHER WAS ALSO LEFT US IN 2011 . I AM THE ELDER SON OF MY FATHER AND I HAD A YOUNGER BROTHER WHO GOT EXPIRED ON 31.12.2025 . WIDOW OF MY YOUNGER BROTHER WANTS VALUE OF HALF OF THE HOUSE AND WANT LEAVE THE HOUSE , NOW WE HAVE DECIDED TO MAKE AN AGREEMENT BETWEEN ME AND HER AND AS PER AGREEMENT I WILL PAY VALUE OF HALF PORTION OF HOUSE . WEATHER THIS AGREMENT WOULD BE VALID IN FUTURE FOR ANY COURT?
Advocate Suryansh Shukla answered
No, a simple written agreement is not legally valid to transfer property. Even if you pay your sister-in-law the money, she could legally claim her share of the house again in the future. To safely get full ownership, you must execute and register a Relinquishment Deed (Release Deed) at the sub-registrar's office. You also need to legally update the property records from your late father's name to yours. Please contact me. I can help you draft the correct deed and get it officially registered so your property is completely secure
